Terms of Service

Users and customers of Services provided by hedtouch.com must accept the terms and conditions of business set out below.

By using Our products/services, You agree to be bound by our policies as described herein and in our Privacy Policy and our Acceptable Use Policy. We reserve the right to change and modify the Terms of Service at any time with or without giving notice. You accept responsibility for checking and familiarizing Yourself with the current Terms of Service. If You do not comply with the current Terms of Service, please don’t use our service.

We make no representation that the domain name you wish to register is capable of being registered by or for you or that it will be registered in your name. You should not assume registration of your requested domain name(s) until you have been notified that it has been registered.

The registration and use of your domain name is subject to the terms and conditions of use applied by the relevant naming authority; ICANN in the case of .COM/NET/ORG and Nominet in the case of domain names ending with .UK you shall ensure that you are aware of those terms and conditions and that you comply with them. You shall have no right to bring any claim against us in respect of refusal to register a domain name. Any administration charge paid by you to us shall be non-refundable notwithstanding refusal by the naming authority to register your desired name.

We shall have no liability in respect of the use by you of any domain name; any dispute between you and any other person must be resolved between the parties concerned in such dispute. If any such dispute arises, we shall be entitled, at our discretion and without giving any reason, to withhold, suspend or cancel the domain name. We shall also be entitled to make representations to the relevant naming authority but will not be obliged to take part in any such dispute.

We shall not release any domain to another provider unless full payment for that domain has been received by us. All charges payable by you for the Services shall be in accordance with the scale of charges and rates published from time to time by us on our website and shall be due and payable in advance of our service provision.

Without prejudice to our other rights and remedies under this Agreement, if any sum payable is not paid on or before the due date, we shall be entitled forthwith to suspend the provision of Services to you.

You shall indemnify us and keep us indemnified and hold us harmless from and against any breach by you of these terms of business and any claim brought against us by a third party resulting from the provision of Services by us to you and your use of the Services.

If you fail to pay any sums due to us as they become due, we may suspend the Services and/or terminate this Agreement forthwith without notice to you.

If you break any of these terms and conditions and you fail to correct the breach within seven (7) days following written notice from us specifying the breach, we may terminate this Agreement forthwith.

If you are a and you go into insolvent liquidation or suffer the appointment of an administrator or administrative receiver or enter into a voluntary arrangement with your creditors, we shall be entitled to terminate this Agreement forthwith.

On termination of this Agreement or suspension of the Services we shall be entitled immediately to block your Web Site and to remove all data located on it. We shall be entitled to delete all such data but we may, at our discretion, hold such data for such period as we may decide to allow you to collect it at your expense, subject to payment in full of any amounts withstanding and payable to us.

Information We Collect

HED Touch may collect information about you as follows:

  • By registering an account, we may collect information provided at the time of registration (name, company name, address, telephone number, and email address).
  • By linking our services to a third-party account, we may collect information from that account such as any authentication tokens involved in authorization.
  • If you contact us, we may collect data regarding your correspondence.
  • We may collect details of your transactions involved in the fulfillment of orders. hedtouch does not store your financial information on our systems. Your financial information is stored with our third-party payment processors. hedtouch does, however, have access to, and may retain, your information through our third-party payment processors.
  • When you visit our website we may capture your IP address, time of and duration of visit, and time and duration of the pages on our website that you view. We may tie this information to personally identifiable information we have about you.
  • When using our services, we may collection information about your utilization, such as processor, memory, storage, and network usage.

Use of Information

We will use your personally identifiable information only as follows:

  • For transaction processing.
  • To provide customer support.
  • To provide, maintain, improve, and expand our services.
  • To understand and analyze how you use our services.
  • For fraud checking, reporting, and other screening methods involving third-party companies in order to verify information submitted to us.
  • To enforce the Acceptable Use Policy (“AUP”) in the detection, prevention, and resolving of abuse.
  • For IP usage reporting to ARIN.
  • To announce special offers or provide other information from time to time via email/sms/push notification in browser.
  • To improve our service and the marketing of our service. For example, we may use the information we gather from user surveys, demographic data, and website visits to help us improve or target our website and customize your visit.

If you register an account through an affiliate referral link, we may share information with your referrer to let them know that you used their referral to order service.

We may also place a “cookie” that will identify you to us as a repeat visitor or a customer when you visit our website. A cookie is an alphanumeric identifier that is unique to your browser. The cookie will identify your browser to us when you visit our website so that we may customize your visit.

We will not provide any personally identifiable information about you to any third-party other than:

  • a law enforcement or regulatory agency as requested via subpoena;
  • a potential business acquirer as part of any proposed merger, acquisition, debt financing, sale of assets, or similar transaction, or in the event of insolvency, bankruptcy, or receivership in which information is transferred to one or more third-parties as one of our business assets;
  • third parties who perform services on our behalf (such as payment processing), subject to the third party agreeing with us that it will keep your personally identifiable information confidential;
  • a fraud detection/prevention service such as FraudRecord or MaxMind;
  • as otherwise needed to protect or enforce the rights of others.

Payment and Delivery of Service

HED Touch allows payment with a limited number payment method. It can change time to time. You can pay with the available payment method you see on our payment page.  The transactions will be executed by an appointed “Payment Gateway”. The Payment Gateway is a separate organization that will collect your payment and forward it to the processing bank for further execution. The Payment Gateway will be responsible for executing all transactions with your banks.

Please note that once you confirm your payment, you will not be able to cancel your order.

We are not allowing remote connection with another server.

Some advanced features may be unavailable due to security reasons, and if it’s an advanced feature, you may request that we give you access. If our technical team thinks it will be a risk factor for our server, then we won’t give you that access. 

We can’t provide any premium domain if show available.

We use third-party licenses and services to enhance our offerings to users. The authenticity of these licenses is solely dependent on the third-party provider, and we cannot guarantee 100% verification of their official status.

Note: We do not provide Terminal/SSH access on Basic or Quality hosting packages for some security reasons. We provide terminal or ssh access only for VPS or dedicated servers. 

Suspension & Cancelation Policy

There are several reasons why your website could potentially become suspended. However, the most common reason for the suspension is Overdue Payment.

  • Malware

Anything malicious or vulnerable found in a client’s or user’s file directory will be treated as a virus or malware, and the account, as well as hosting, will be suspended for the server’s and clients’ or users’ safety. We discourage you from using or uploading any corrupted, vulnerable, or malicious files.

  • Phishing

Phishing is a method of gathering personal information using deceptive e-mails, websites, and the site content that falsifies legitimacy, taken or adjusted from a legitimate company, to gain sensitive information or personally identifiable information.

  • High Uses

The site you use will be suspended when the resource (cpu, ram, core, I/O etc) you use exceeds your allowed limit.

  • High bulk mail or spam mail

If you want to send or receive bulk , spam mail from your account or do banned email marketing, your account will be suspended or terminated without any previous notice and you will have to pay high penalty if any damage is done to the server due to your bulk mail.

  • Copy right

If claim against copyright for the service you purchased or complaint against your web site data , your account will be suspended. If there is a serious issue, the account may be terminated. Like Movie site highly restricted.

  • Adult content

Not allow any Pornographic site, Picture a or any other sexually content. Pornography Ads that feature or promote the following types of sexual content are strongly restricted.

  • Betting Site

Betting site is not allowed in our company. It’s highly restricted from this company and Bangladesh government. If He/She lead any type of betting site, it will be suspended or terminated at any time from hedtouch. It will be no refundable.

  • Crime

Anyone who engages in anti-government activities, spreads false or misleading information, or otherwise tarnishes the country’s or government’s reputation will have their account or hosting suspended. We are alerting you that your account or hosting may be suspended permanently.

Note: If your account has been suspended, you will see a page stating that your account has been suspended when you try to visit your domain.

As soon as you see the suspended text, you will need open a ticket from your client area, and then hedtouch team will tell you why the account has been suspended. Once you know the reason, you will correct your previous mistake and request to be unsuspended within 72 hours or the given time in the mail of the suspension; otherwise, we may terminate it permanently. 

Refund Policy

If you are unhappy with any aspect of our service, please contact our technical department, which will attempt to rectify the situation. If the problem cannot be fixed and you are unhappy with the service, you are entitled to a refund within 30 days. There are no refunds after the 30 day period. Refunds are not available for.COM,.NET,.ORG,  or any other domain names, SSL Certificates, Domain transfer-in fees, Domain transfer-out fees, or any other products or services provided by hedtouch.com through other companies. No refunds are provided for VPS or Dedicated servers under any circumstances. No refunds will be made if we terminate your hosting or other services due to violation of our Acceptable Use Policy or any other violation of our Terms and Conditions, except as may be provided therein.No refund is possible for those hosting packages which offer free domain. This does not affect your statutory rights. Credit on your account cannot be refunded and must be used for purchases and renewals. addons and Setup fees are non-refundable. Accounts purchased under a promotion, with or without a promo code, are excluded from the 30-day money-back guarantee. Any funds sent to hedtouch.com that are in excess of the amount owed can only be reimbursed in credit and cannot be refunded.

hedtouch does not offer any refunds for basic & quality hosting for cancellations that occur after 30 days. And also, change of mind is not applicable in 30 days. For monthly services such as VPS or dedicated servers, there are no partial or full refunds. But if you have subscribed for any of this for more than one month, you will get a full refund for unused periods. There is no refund for web services such as web design & development, web templates and themes, technical assistance, etc. There is no refund for hosting services which offer free domain as domain are not eligible for refund.

service charge 250tk will be deducted from your refund amount. 

Renew Policy

You must renew your domain and hosting at least 7 days before the expiration date. 

For domains, you will see an expiration notification on your account page. So, we don’t send any separate domain renewal warnings. So you have to be careful about the expiration date.

For hosting, we will send you an email, SMS, or both notifications to renew your services. 
If you don’t renew your domain and hosting and it is suspended, you can renew it any time before the expiration date. After the expiration date has passed, you may be able to renew it with late fees within 7–15 days.
After 7–15 days, you may lose your domain and hosting forever. 

Late fees depend on the registry and various other factors; you can contact us to know the amount at the given time. 

Data Backup / Preservation

You, the user, are ultimately responsible for maintaining backups of your data. This includes website files, databases, emails, and any other information stored on our servers. We recommend using a combination of methods for your backups:

  • Local Backups: Regularly download backups of your data to your local computer.
  • Plugin Backups (WordPress): If you use a WordPress website, consider utilizing plugins specifically designed for WordPress backups.

While server crashes are relatively uncommon, it’s important to acknowledge that they can occur due to the inherent unpredictability of computer systems. Despite robust maintenance and monitoring, there is no absolute guarantee against such events. Therefore, you must keep your own website backup to yourself so that you can restore them anytime you want. 

In the event of data loss, Our default action will be to restore Your services to their “day one” state. We endeavor to maintain backups of Your data for Our use in restoring services as needed. These backups may or may not be available to You, at Our discretion, unless You have explicitly purchased backup services from Us. Any complimentary backup files provided to You will be a raw copy of Your data; it is Your responsibility to restore Your data. If You have purchased backup services from Us, We will restore backups to Your services with Us; We will not restore backups to any third-party service or network. Additionally, We do not guarantee that backups will be restorable, either to Our network or to a third party. We do not guarantee that Our backup will restore Your data to any specific point in time. We will not offer compensation for data loss or costs resulting from data loss unless You have explicitly purchased backup services from Us. If You have purchased backup services from Us, Our liability shall be limited to the monthly subscription price of Your service with Us
